terms and conditions
All commissioned artwork and invitation projects must begin with a signed contract between Cassie Carpenito and the client. The contract will describe the terms and conditions of project inclusions, usage, rights, and payments. The rules below are the standard contract terms applicable to all artwork created by Cassie.
Copyright & Original or Native Files
Cassie does not release any digital work in editable, native or original file format. This includes but is not limited to the files themselves, the techniques they use, or how ideas are developed. Under U.S. copyright law as an independent contractor, Cassie is the “author” and copyright owner of all work created, meaning she has exclusive rights under copyright law (the rights to make and distribute copies and make adaptations or changes to the work). These exclusive rights are nontransferable.
In special circumstances, Cassie may allow a vendor to distribute copies of art prints. Terms for distribution will be determined in a signed contract prior to distribution.
Designs & Proofing
The designs included in the package are for the full designs only. Any graphics created additionally, such as a monogram or pattern, are not available as individual files unless an additional fee is discussed and contract of usage rights is signed.
Each commissioned art piece and digitally illustrated invitation includes an initial proof and two rounds of changes to that design. If more changes are requested, a fee will apply to each additional change. Cassie will communicate any fees before completing additional changes.
The client has the responsibility to proofread and examine all work produced during the project. The client is ultimately responsible for any typographical, spelling, grammatical, copy, photographic, illustrative, layout, or other errors discovered after approval.
Scope of Work
Any items not listed within the contract or within their description online are subject to additional fees. No additional fees will be added without consent of the client. Additional items could include but are not limited to: specialty cardstock, extra printed items, etc.
Timeline is dependent on feedback and changes between Cassie and the client. The initial project idea will be delivered within a time determined by Cassie and the client. Most projects require at least two weeks to complete. After finalization of the project, client is responsible for payments of any additional changes or edits.
Please remember that monitors display colors differently, therefore the colors on the products you receive may vary slightly from the image you see on your screen. If a specific color is important, please communicate this to Cassie who will work with the design and printer to get the color exact.
Finals & Printing
All finalized digitally illustrated invitations are delivered via email. The cost includes electronic delivery and a proof of project. Printing and shipping come at an additional cost. If client chooses to utilize their own print shop, client releases Cassie from any liability and errors made during printing.
Commissioned art pieces include insured shipping in a rigid photo mailer. If you would like to order additional prints of the piece, these will come at an additional cost.
Unless otherwise specified, each project will be paid up-front prior to artwork beginning. Special exceptions may be made for large on-going projects, in which case payment shall be received in two installments: half of the total amount due at the beginning of the project and half upon delivery of final proof with watermark, prior to printing.
Invoices are delivered via email, unless otherwise requested or specified. Once the invoice is delivered, the client will have 10 days to pay the balance. Artwork will not begin until invoice has been paid.
For final installments, a 10% interest fee will be added if the invoice is not paid by the due date. An additional 5% interest will be added for every 10 days after the due date, in the event that it goes unpaid. The invoice can be paid via electronic check or credit card. If the balance is $50 or more, payments by credit card are subject to an additional fee of 4%.
Rush orders are any orders that need to be completed (meaning initial design and rounds of changes) in under two weeks. Rush fees start at 25% of the total design cost with a minimum of $25. Fees and timeline of completion are dependent upon the project and amount of work required and are subject to change.
